🔹 Process Overview

1. Filing the Petition

   • U.S. citizen or green card holder files Form I-130 (Petition for Alien Relative) with USCIS.

   • Proves the family relationship (marriage, birth, adoption, etc.).

2. USCIS Review

   • Once approved, the petition is sent to the National Visa Center (NVC) for consular processing OR stays with USCIS if adjusting status in the U.S.

3. Visa Availability

   • For immediate relatives → visas are always available.

   • For family preference categories → must wait for a visa number (see the Visa Bulletin each month).

4. Immigrant Visa / Adjustment of Status

   • If abroad: Consular Processing → attend visa interview at U.S. embassy.

   • If in the U.S.: File Form I-485 (Adjustment of Status) once a visa number is available.

5. Green Card Issuance

   • Upon approval, the beneficiary becomes a lawful permanent resident (green card holder).
