EB-2 NIW (National Interest Waiver)

The EB-2 NIW (Employment-Based, Second Preference, National Interest Waiver) is a U.S. immigration category that allows certain foreign nationals to obtain a green card without employer sponsorship if their work benefits the national interest of the United States.

🔹 EB-2 NIW Overview

EB-2 NIW is part of the EB-2 category, typically requiring:

  • A job offer from a U.S. employer

  • A labor certification (PERM process)

But with National Interest Waiver (NIW), both the job offer and PERM requirement are waived.


🔹 Eligibility Requirements

To qualify for EB-2 NIW, you must meet:

1. EB-2 Basic Criteria (One of the following):

  • Advanced Degree (Master’s or higher, or equivalent bachelor’s + 5 years experience)

  • Exceptional Ability in sciences, arts, or business (must meet 3 of 6 USCIS criteria)

2. National Interest Waiver (NIW) Criteria

USCIS uses the Dhanasar framework, which requires that:

  1. The proposed endeavor has substantial merit and national importance

    • Example: research in medicine, technology, education, energy, etc.

  2. You are well positioned to advance the endeavor

    • Education, work experience, publications, funding, awards, etc.

  3. Waiving the labor certification would benefit the U.S.

    • Your work is so important that the U.S. should allow you to immigrate without a job offer or labor certification.
