🔹 What Is EB-3?

The EB-3 visa allows U.S. employers to sponsor foreign workers for permanent residence (green card). It’s a great path for individuals with moderate qualifications who want to live and work permanently in the U.S.

🔹 EB-3 Subcategories

There are three subcategories under EB-3:

1. Skilled Workers

  • Requires at least 2 years of job experience or training.

  • Job cannot be seasonal or temporary.

  • Example: chefs, construction workers, technicians.

2. Professionals

  • Must hold a U.S. bachelor's degree or foreign equivalent.

  • Job must require a bachelor’s degree.

  • Example: teachers, engineers, accountants.

3. Unskilled Workers (Other Workers)

  • Jobs requiring less than 2 years of experience or training.

  • Cannot be seasonal or temporary.

  • Example: cleaners, fast-food workers, farm laborers, caregivers.

🔹 Key Requirements

For the Applicant (You):

  • Meet the education or work experience based on subcategory.

  • Be otherwise admissible to the U.S.

For the Employer:

  1. Job Offer: Must offer a full-time, permanent position.

  2. Labor Certification (PERM):

    • Prove no qualified U.S. worker is available.

    • Conduct a recruitment process.

  3. Wage Requirement: Offer prevailing wage for the position.

🔹 Application Process

Step 1: PERM Labor Certification

  • Employer files with the U.S. Department of Labor (DOL).

  • Involves job advertising and proving no U.S. worker is available.

  • May take  18 months.

Step 2: Form I-140 (Immigrant Petition)

  • Filed by employer to USCIS.

  • Confirms job, wage, and employee qualifications.

  • May take 6–12 months (premium processing available).

Step 3: Green Card Application

  • If in the U.S.: File Form I-485 (Adjustment of Status).

  • If outside the U.S.: Apply through Consular Processing (DS-260).

  • Depends on visa bulletin (priority date must be current).

🔹 Processing Time

  • Entire process can take 4 to 4+ years, depending on:

    • Country of origin (India/China have longer waits).

    • USCIS/DOL processing speed.

    • Category (skilled, professional, unskilled).

🔹 Advantages

  • Does not require an advanced degree.
